LE COMPETENZE DELLA REGIONE SICILIANA E LA TUTELA DEL PAESAGGIO NELLA LETTURA DEL TAR SICILIA

ABSTRACT: This article analyses the recent decision of the Regional Administrative Court (TAR) for Sicily concerning the legal action brought by Energia Pulita Italiana 2 S.r.l. against the measures adopted by the Ministry of the Environment and Energy Security and the Ministry of Culture within the framework of the Environmental Impact Assessment (EIA) procedure for the construction of an agrivoltaic park in the municipality of Mineo (Catania). The claimant contested the competence of the Ministry of Culture to intervene in the EIA process concerning land located in Sicily, arguing that, under the Sicilian Special Statute, exclusive jurisdiction over landscape protection lies with the Region. The TAR upheld this claim, relying on settled administrative case law affirming the exclusive competence of the Sicilian Region in landscape matters, and declared the Ministry of Culture’s intervention ultra vires. This ruling further clarifies the distribution of administrative powers between the State and the Regions in the context of environmental governance and reinforces the special autonomy regime of Sicily in cultural and landscape protection.
