Abstract [IT]. Il presente contributo si propone di indagare la particolare e complessa condizione assunta dalla figura femminile nell’alveo delle dinamiche mafiose, con precipuo riferimento alle ipotesi in cui la donna decida di assumere, nell’ambito del processo penale, la veste di collaboratore o di testimone di giustizia. Dopo aver posto l’attenzione su quella che è la disciplina vigente in materia, si porrà l’accento sul dissidio che alberga in colei che decida di intraprendere un percorso di rottura e di rinascita, recidendo il vincolo con la consorteria criminale. Un conflitto interno che si manifesta, irruentemente, attraverso due rappresentazioni contrapposte: da un lato, l’aspirazione a emanciparsi da un ambiente marcatamente patriarcale; dall’altro, la vulnerabilità emotiva di chi fatica a rompere il legame affettivo con un contesto che ha rappresentato, fino a quel momento, fondamento identitario ed emotivo. La manifestazione di una volontà positiva di cooperare con la giustizia trova espressione nella figura del collaboratore di giustizia, la cui qualifica si distingue da quella del testimone di giustizia. Pur accomunati da analoghi intenti, le due figure si differenziano tanto per la loro condizione soggettiva, tanto per il differente regime di protezione loro applicabile. In tale prospettiva, l’atto di infrangere il muro dell’omertà si configura non soltanto come apporto probatorio di rilevante portata, ma, soprattutto, come gesto di emancipazione e autodeterminazione della propria soggettività.

Abstract [En]. This paper aims to investigate the particular and complex condition assumed by women within the context of mafia dynamics, with particular reference to cases in which women decide to act as collaborators or witnesses for the prosecution in criminal proceedings. After focusing on the current legislation on the subject, emphasis will be placed on the conflict that arises in women who decide to embark on a path of rupture and rebirth, severing their ties with the criminal organization. This internal conflict manifests itself impetuously through two opposing representations: on the one hand, the aspiration to emancipate oneself from a markedly patriarchal environment; on the other, the emotional vulnerability of those who struggle to break the emotional bond with a context that has, until that moment, represented the foundation of their identity and emotions. The manifestation of a positive willingness to cooperate with the justice system is expressed in the figure of the justice collaborator, whose status differs from that of a justice witness. Although they share similar intentions, the two figures differ both in their subjective condition and in the different protection regimes applicable to them. From this perspective, the act of breaking the wall of silence is not only a significant contribution to the evidence, but above all a gesture of emancipation and self-determination of one’s own subjectivity.
