Landscape as Event. Article 518-duodecies of the Italian Criminal Code and the Measure of Harm to Landscape Assets between Protection Order, Authorisation and Offence

Abstract. La stessa premessa riconduce all’art.

Abstract. The paper examines Article 518-duodecies of the Italian Criminal Code insofar as it protects landscape assets. It argues that, as an offence of harm, its result must be measured against the values identified and reasoned in the act imposing landscape protection. Physical integrity of the land alone cannot supply that measure. The author draws three consequences: administrative authorisation is irrelevant to the definition of the offence; the offence formally concurs with Article 181 of the Cultural Heritage Code; and its relationship with the contravention in Article 734 of the Criminal Code is one of speciality. The same premise brings mistakes about the existence and content of the protection order within the scope of Article 47 (mistake of fact), which case law tends to treat as ignorance of criminal law. The thesis is tested against recent Court of Cassation case law, the amendments introduced by Law No. 6 of 2024, and the evidentiary techniques used to establish harm at the precautionary stage.
