LE DROIT ITALIEN DE L’URBANISME TRANSFRONTALIER
LE RÔLE DU JUGE ADMINISTRATIF *

Abstract.
Abstract. In Italy, cross-border spatial planning has developed and continues to develop within the framework of environmental protection, given the close interconnection between territory and the environment. As with the environment, territory is also gradually becoming a ‘common good’, consequently, its planning is a matter of common interest. Administrative procedures should therefore strengthen legal techniques such as stakeholders’ participation, regardless of stakeholders’ nationality. A consultative approach should be chosen in order to achieve shared decision-making. Within the framework of the European Grouping of territorial Cooperation, the experience of Gorizia – three cities located in two different States but forming a single cross-border urban area – shows the possibility of providing shared responses to shared needs, through the promotion of joint governance and collaborative initiatives. In this context, Administratives Courts as the ‘natural judge’ of spatial planning and of the discretionary power of public authorities – help to ensure the effective implementation of the principles of cooperation, participation and ‘substantive legality’.
