Abstract [It]: Il contributo esamina la portata degli effetti fiscali derivanti dalla certificazione dei contratti di lavoro ex art. 75 ss. d.lgs. n. 276/2003 alla luce delle coordinate interpretative offerte dalla giurisprudenza di legittimità. L’indagine prende le mosse dalla tradizionale ricostruzione della certificazione quale “scudo” opponibile ai terzi – inteso come limite all’adozione di atti fondati su una qualificazione del rapporto difforme da quella certificata – al fine di verificare se tale impostazione conservi attualità e tenuta dinanzi ai principi affermati dalla Sezione Tributaria e, successivamente, dalla Sezione Lavoro della Corte di Cassazione. Se, sul piano processuale, viene cristallizzata l’inopponibilità all’autorità giudiziaria della qualificazione contenuta del provvedimento di certificazione, maggiori incertezze connotano la dimensione procedimentale, nella quale alcune affermazioni dei giudici di legittimità sembrano legittimare letture non pienamente coerenti con il dato normativo. In tale prospettiva, con specifico riguardo all’Amministrazione finanziaria, il contributo si interroga sulla possibilità di riconoscere un’efficacia differenziata della certificazione rispetto agli altri terzi, proponendo un’interpretazione che superi la tradizionale opponibilità dell’atto, ma che valorizzi, al contempo, l’autonomia e la peculiarità della materia tributaria, senza però porsi in contrasto con il dettato normativo. La soluzione proposta, volta a riconoscere in capo all’ente un autonomo potere di (ri)qualificazione, lungi dallo svuotare di significato la locuzione «ai fini fiscali» contenuto nell’art. 78 d.lgs. n. 276/2003, ne suggerisce una reinterpretazione in chiave probatoria e motivazionale, coerente con i principi ispiratori della materia fiscale.
Abstract [En]: This contribution examines the scope of the tax effects arising from the certification of employment contracts pursuant to Articles 75 et seq. of Legislative Decree No. 276/2003, in light of the interpretative guidance provided by the case law of the Italian Court of Cassation. The analysis starts from the traditional understanding of certification as a “shield” enforceable against third parties — namely, as a limit on the adoption of measures based on a legal characterisation of the relationship that differs from the certified one — in order to assess whether such reconstruction remains current and systematically sound in light of the principles affirmed by the Tax Section and, subsequently, by the Labour Section of the Court of Cassation. While, at the judicial level, the non-binding nature of the characterisation contained in the certification measure vis-à-vis the courts appears to be settled, greater uncertainty arises in the administrative-procedural dimension, where certain statements of the Court seem to support interpretations not fully consistent with the statutory framework. From this perspective, with specific regard to the Tax Administration, the contribution investigates whether certification may be recognised as having a differentiated effect compared with other third parties, proposing an interpretation that moves beyond the traditional opposability of the act while, at the same time, enhancing the autonomy and specific features of tax law without departing from the wording of the statute. The proposed solution, by recognising an autonomous power of recharacterisation vested in the authority, does not deprive the expression “for tax purposes” contained in Article 78 of Legislative Decree No. 276/2003 of its meaning; rather, it suggests a reinterpretation of that expression in evidentiary and motivational terms, consistently with the guiding principles of tax law.
