Abstract [IT]: Il presente contributo propone di esplorare la complessa relazione tra il regionalismo differenziato il cui processo di concretizzazione è stato ri-attivato dal decisore politico nella legge n. 86/2024 in attuazione dell’art. 116, comma 3, Cost., e la tutela ambientale, attraverso l’elaborazione della categoria della «asimmetria ecologica». Muovendo dall’affermazione dell’ambiente quale oggetto di un principio costituzionale trasversale secondo l’attuale formulazione dell’art. 9 Cost., la riflessione avrà a suo principale oggetto di analisi le forme e le condizioni attraverso le quali la eventuale attribuzione asimmetrica alle Regioni di funzioni pubbliche nella com­plessa materia della tutela ambientale potrebbe armonizzarsi con la peculiare natura di quest’ultima. In particola­re, si metterà in rilievo come l’eventuale assegnazione differenziata di specifiche funzioni – e, giammai, dell’inte­ra materia – nel rispetto della clausola di adeguatezza prevista dall’art. 116, comma 3, Cost., potrebbe efficace­mente ridefinire il rapporto tra Stato e Regioni nell’orizzonte della tutela multilivello dell’ambiente, affidata alla Repubblica nella sua integralità.

Abstract [En]: The paper proposes to explore the complex relationship between differentiated regionalism – the process of implementation of which was reactivated by the legislature through Law No. 86/2024, enacted pursuant to Article 116(3) of the Italian Constitution – and environmental protection, through the elaboration of the cate­gory of «ecological asymmetry». Proceeding from the affirmation of the environment as the object of a cross-cutting constitutional principle under the current formulation of Article 9 of the Constitution, the analysis focuses primarily on the forms and conditions through which the possible asymmetric attribution to the Regions of public functions within the complex subject-matter of environmental protection could be reconciled with the peculiar nature of the latter. In particular, the article highlights how the differentiated assignment of specific functions – and never of an entire subject-matter – in compliance with the adequacy clause set forth in Article 116(3) of the Constitution, could effectively redefine the relationship between the State and the Regions within the framework of the multilevel protection of the environment, entrusted to the Republic in its entirety.
