Abstract [It]: Il presente scritto ha ad oggetto l’istituto dell’avvalimento, di cui si proporrà un inquadramento alla luce sia del disposto del d. lgs. 36/2023 che della più recente giurisprudenza. Successivamente se ne metterà in luce la natura, a metà tra procedimento ed espressione di volontà, e si passeranno in rassegna i problemi lasciati aperti dalla novella.

Abstract [En]: This writing has as its object the institution of third-party reliance, of which a framework will be proposed in light of both the provisions of the Legislative Decree 36/2023 and the most recent jurisprudence. Subsequently, its nature will be highlighted, halfway between procedure and expression of will, and the problems left open by the novel will be reviewed.
