Abstract [It]: Complice il crescente interesse verso l’acquisto di carbon credits per compensare le emissioni di gas serra derivanti dai processi produttivi, i mercati del carbonio hanno conosciuto una rapida espansione. Al crescere dell’importanza di tali strumenti economici, non hanno tuttavia tardato a emergere alcuni profili di criticità, soprattutto per quel che riguarda la trasparenza delle condizioni di negoziazione, la qualità dei carbon credits e la complessità del quadro regolamentare. Premessa qualche considerazione sulla natura giuridica delle quote di emissione, lo scritto tratteggia i lineamenti dei mercati del carbonio, mettendo in luce le differenze tra Compliance Carbon Markets e Voluntary Carbon Markets e i rispettivi elementi di criticità. Oltre a ciò, viene esaminata la Guidance dalla U.S. Commodity Futures Trading Commission relativa alla negoziazione dei Voluntary Carbon Credit derivative contracts. Documento, recentemente adottato, avente lo scopo di garantire che la progettazione e la negoziazione di contratti derivati connessi a tematiche ambientali avvenga in modo sicuro, affidabile e nel rispetto degli standard di mercato esistenti.

Abstract [En]: Carbon markets have undergone rapid expansion, driven by the growing interest of operators in certain industries in purchasing carbon credits to offset greenhouse gas emissions resulting from industrial processes. However, as the significance of these economic instruments has increased, a number of critical issues have emerged, particularly with respect to the transparency of trading conditions, the quality of carbon credits, and the complexity of the applicable regulatory framework. After providing some preliminary considerations on the legal status of greenhouse gas emission allowances, this paper outlines the structure and key features of carbon markets, highlighting the differences between Compliance Carbon Markets and Voluntary Carbon Markets, as well as their respective critical aspects. Additionally, the article examines the Commission Guidance Regarding the Listing of Voluntary Carbon Credit Derivative Contracts, a document recently issued by the U.S. Commodity Futures Trading Commission (CFTC). This guidance aims to ensure that the design and trading of derivatives related to environmental issues are conducted in a safe, reliable, and standards-compliant manner.
